Purpose

OALI makes and sells blooming candles made from plant-based wax and fragrances from Grasse.

The customer visits the website and fills the shopping basket with the products they wish to purchase. The customer then accepts the general terms and conditions and pays for the order using one of the payment methods available on the site. The customer then confirms the order, and OALI sends an order confirmation email. The sales contract between OALI and the customer is concluded on receipt of this confirmation email.

OALI reserves the right to request additional information from the customer and to refuse certain orders, in particular if the customer is a minor, if there is an ongoing dispute, if stock levels do not allow the order to be fulfilled or if there is an obvious error in the description or price of the products. Only persons with legal capacity may place an order.

Acceptance of the general terms and conditions means acceptance of the conditions they contain.

Application and acceptance of the general terms and conditions of sale

The main characteristics of the products, in particular their specifications, illustrations and indications of size or capacity, are presented on the oali.be website, and the customer must read them before ordering. The choice and purchase of a product are the sole responsibility of the customer. Product offers are valid while stocks last, as specified when the order is placed. These terms are available at any time on the oali.be website and prevail over any other document.

In all cases, an order implies the customer's express and irrevocable acceptance of these general terms and conditions. The customer will receive, in the order confirmation email, a link to the general terms and conditions in a format that can be saved or printed. Some provisions of the general terms and conditions apply only to consumers.

Unless proven otherwise, the data recorded in the seller's IT system constitutes proof of all transactions concluded with the customer.

Delivery and payment costs and terms

Any delivery costs are shown in the order summary on the website before the customer confirms the order. These costs are also included in the confirmation email. OALI undertakes to do everything possible to deliver within a maximum of 5 working days in Belgium and 8 working days in other countries to the address given by the customer. For security reasons, the customer may be asked to show proof of identity on delivery. If the customer is absent when the carrier calls, the parcel will be made available at a collection point near the destination. The customer may not claim any compensation in the event of late delivery.

Any defect may be reported to the carrier or to the collection point. If some products do not conform at the time of delivery, the customer is also asked to inform OALI customer service as soon as possible.

Prices and information on the website

All prices shown on the website include VAT and other taxes. These prices may be changed at any time and do not include, where applicable, delivery costs, which are charged in addition. The prices paid by the customer are those shown on the site at the time of the confirmation email, except in the event of an obvious error. These prices are firm and cannot be revised during their period of validity, but the seller reserves the right to change prices at any time outside that period.

The photos and other illustrations used to present the products are not binding and may show products or items not included in the price offered.

Orders

It is up to the customer to select on oali.be the products they wish to order, as follows:

The customer chooses a product and adds it to the basket; the product can be removed or changed before the customer confirms the order and accepts these general terms and conditions of sale. The customer then enters their details and chooses the delivery method. Once the information has been confirmed, the order is considered final and requires payment from the customer under the terms provided.

Product offers are valid as long as they are visible on the site, while stocks last.

The sale is only considered valid once the price has been paid in full. The customer is advised to check that the order is correct and to report any error within two months.

Any order placed on oali.be forms a distance contract between the customer and the seller.

The seller reserves the right to cancel or refuse any order from a customer with whom there is a dispute concerning the payment of a previous order.

The customer may only cancel an order before the products have been dispatched (regardless of the provisions on whether or not the statutory right of withdrawal applies).

Gift cards

OALI offers digital gift cards worth €50, €100, €150 or €250, payable online. The card is sent by email, to the recipient or to the buyer, on the date chosen at the time of purchase.

The card is valid for one year from the date of purchase; its expiry date is shown in the accompanying email. It can be used on oali.be to buy products and pay delivery costs, in one or several goes, until the balance is used up. When the amount of an order exceeds the balance, the difference is paid with another payment method. Any balance not used by the expiry date is lost.

The gift card cannot be refunded or exchanged for cash, even partially, nor used to buy another gift card. It is reserved for consumers and cannot be used on a trade account.

The card code is a means of payment and must be kept safe. If the email is lost, customer service can resend it to the address given at the time of purchase.

The buyer has 14 calendar days from purchase to cancel a gift card that has not yet been used: the buyer is then refunded and the card is deactivated. If an order paid in whole or in part with a gift card is cancelled or returned, the corresponding amount is credited back to the card.

Right of withdrawal (consumers only) and return costs

The customer has 14 calendar days from receipt of the order to exercise the right of withdrawal, without penalty and without having to give a reason.

The period runs from the day:

1° the contract is concluded, for services;

2° the goods are received by the consumer or by a third party other than the carrier designated by the consumer, for sales of goods.

For an order of several items delivered separately, the period starts from receipt of the last item.

To exercise this right, the customer can contact customer service via the contact page of the site, return the official withdrawal form (see link below) or send a clear request by post or email. The customer may ask for an exchange or a refund.

During the withdrawal period, the customer must keep the products and their packaging in good condition. The products must not be used or unpacked. To be returned, they must be in their original condition and packaging.

The products must be returned within a maximum of 14 days after notification of withdrawal, to the following address:

RUE VANKEERBERGHEN 31, 4500 HUY, BELGIUM.

Return costs are borne by the customer.

OALI refunds the amount of the order and all payments received in connection with it, except delivery costs.

Where delivery was free at the time of the order, OALI reserves the right to deduct from the refund the amount corresponding to the delivery costs actually incurred for the initial shipment. As free delivery is conditional on the order being kept, these costs are not refunded in the event of total withdrawal.

The refund will be made to the bank account provided by the customer, within 14 days of actual receipt of the returned products.

The customer may be held liable for any handling beyond what is necessary to establish the nature, characteristics or proper functioning of the products.

The right of withdrawal does not apply to goods:

  • made to the customer's specifications or clearly personalised;
  • liable to deteriorate or expire rapidly;
  • sealed and unsealed after delivery, for reasons of hygiene or health protection.

Emails and the website's automatic recording systems serve as proof, in particular of the date and content of the order.

Liability

OALI stresses that candles must be used by adults only, placed on non-flammable surfaces, at least 1 m away from any flammable object and kept out of the reach of children and pets. OALI cannot in any case be held liable for misuse of the products.

OALI's liability is in any event limited to the amount of the order and cannot be engaged for simple errors that may have remained despite all the care taken in presenting the products. OALI cannot under any circumstances be held liable for indirect or consequential damage, or for damage that was not foreseeable at the time of the order. Photos, illustrations and product sheets do not bind OALI; this information is given as an indication only. The customer undertakes to read carefully the instructions provided by the manufacturer on or in the product packaging.

Miscellaneous

If any provision of these general terms and conditions is declared invalid, illegal or void, this does not affect the validity, legality or applicability of the other provisions. OALI's failure to require strict application of one or more provisions of the general terms and conditions does not constitute a tacit waiver of its rights and does not prevent it from later requiring strict compliance with those provisions.

OALI is not liable for delayed performance or non-performance of the service due to force majeure. Cases of force majeure include war, riot, insurrection, transport interruption, import or export problems, strikes, lock-outs, shortages, fire, earthquake, storms, floods and any other case recognised by the Belgian courts. In the event of force majeure, OALI may deliver the products within 60 days of the contractually agreed date. After this period, the customer may cancel the order.

Any dispute is governed by Belgian law. Only the courts of Liège have jurisdiction.

You can report your dispute on the European ODR platform: https://ec.europa.eu/consumers/odr/.
